By creating an account, accessing theNicenails mobile application or related websites, or using any feature we offer, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
If you useNicenails as a nail artist (including as a member of a studio), you must also accept the Artist marketplace terms where the app requires it.
Nicenails is an online marketplace and software platform that helps customers discover nail designs and artists, request or confirm appointments, and (where enabled) pay or manage aspects of the relationship in the app. We may add, change, or remove features as we develop the product.
Early access. The service may be offered in beta or limited release. It may contain defects or downtime. We do not warrant that the service will be uninterrupted or error-free.
Not a salon. Except where we explicitly say otherwise, we do not perform nail services. Nail services are provided by independent artists or studios you select through the platform.
Sign-in and account security may be provided by Clerk (or another provider we disclose). Their terms and privacy notice apply to their processing. We store a record of your account in our systems as described in the Privacy Policy.
Bookings. When you confirm or request a booking through the app, you agree to the timing, price, and design context shown in the booking flow, subject to any cancellation or reschedule rules we publish and to the artist’s reasonable salon policies.
Off-platform payment. Where in-app payment is not available or not used, payment for the appointment may be arranged directly between customer and artist. We are not a party to that payment unless we explicitly facilitate it in the product. Each party remains responsible for tax, receipts, and disputes for amounts not processed by us.
In-app payment. Where Stripe or similar is enabled, additional terms and receipts may be shown at checkout. Platform fees (if any) will be disclosed before you complete payment.
You may submit reviews, images, text, or other content (“Your content”) in accordance with these Terms. You retain ownership of Your content, but you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, display, and distribute Your content as reasonably necessary to operate, promote, and improveNicenails (including on the app, in emails we send on your behalf, and in marketing where you have agreed or where anonymised).
You must not submit content that is unlawful, defamatory, infringing, hateful, or that contains malware. We may remove content or accounts that breach these Terms or that we reasonably believe create legal or safety risk.
Without limiting the above, you must not upload, share, or otherwise distribute content that includes graphic violence, sexual content or nudity, child sexual abuse material, extremist content, self-harm encouragement, or other content that is illegal, exploitative, or unsafe. We may remove such content immediately, restrict visibility, and suspend or terminate accounts involved.
If you see content that may breach these Terms, you may report it to info@nicenailsapp.com (and via in-app reporting where available). We may review reported content manually or with automated tools, and may take action including warning, removal, temporary suspension, permanent blocking, or referral to law enforcement where required by law.

The service may integrate or link to third parties (for example maps, payments, email, push notifications). Their terms govern your use of those features. We are not responsible for third-party services we do not control.
TheNicenails name, logo, app design, and our proprietary software and documentation are owned by us or our licensors. Except for the limited rights to use the app in these Terms, we grant you no licence to our intellectual property.
You may stop usingNicenails at any time and may request account closure via info@nicenailsapp.com or follow Delete account.
We may suspend or terminate access if you materially breach these Terms, if we are required to by law, or if continued provision would create unacceptable risk. Where reasonable, we will give notice. Provisions that by their nature should survive (including liability limits where enforceable, and licence grants for content already displayed) survive termination.
Serious safety or content violations (including prohibited imagery) may result in immediate suspension or permanent account blocking without prior notice where we reasonably consider urgent action necessary to protect users, comply with law, or protect the platform.
To the maximum extent permitted by New Zealand law, the service is provided “as is” and “as available”. We disclaim implied warranties where allowed.
We are not liable for the quality, safety, or legality of nail services performed by artists; for disputes between users; or for indirect or consequential loss, except where such exclusion is not permitted by law.
To the extent permitted by law, you agree to indemnify and hold harmlessNicenails and its directors, officers, and employees from claims, damages, and costs (including reasonable legal fees) arising from Your content, your breach of these Terms, or your misuse of the service. Counsel should confirm scope for consumers vs business users.
These Terms are governed by the laws of New Zealand. Subject to mandatory consumer protections, the New Zealand courts have non-exclusive jurisdiction.
We may modify these Terms. We will post the updated version here and change the “Last updated” date. If changes are material, we will provide such notice as required by law (which may include in-app or email notice). Your continued use after the effective date of changes constitutes acceptance unless the law requires a different consent mechanism.
